Welcome to Txrmetal!

The terms “we,” “us,” and “our” refer to RHONDA HOLLANDER HOLDINGS, LLC, operating the Txrmetal store at txrmetal.com.

We provide this website, including its content, shopping features, products, and customer support, collectively referred to as the “Services.” Our store is powered by Shopify.

These Terms of Service, together with the policies referenced below, explain your rights and responsibilities when using our Services:

Please read these Terms before placing an order. By using our Services, you agree to these Terms to the extent permitted by applicable law.

Nothing in these Terms excludes or limits consumer rights that cannot legally be waived.

SECTION 1 — ACCESS AND ACCOUNT

To place an order, you must be legally able to enter into a purchase agreement. A parent or legal guardian must place orders on behalf of minors.

Please provide accurate and current contact, billing, payment, and shipping information so we can process your order and contact you when necessary.

If you create an account, keep your login details confidential and notify us promptly if you suspect unauthorized access.

You must be authorized to use any payment method submitted with your order.

SECTION 2 — OUR PRODUCTS

Our catalog includes footwear for adults, children, and toddlers, as well as shoe charms, decorative accessories, shoe tattoos, bags, pouches, and compatible electronic cases.

Please review the individual product page for the product’s description, materials, size, color, compatibility, included components, and safety instructions.

We aim to describe products accurately. Colors may appear slightly different depending on screen settings, lighting, and photography. This does not limit your right to a remedy when a product is defective or materially different from its description.

Footwear sizing: Products may use men’s, women’s, combined M/W, children’s C, junior J, or other size labels. Please check the specific sizing information before ordering.

Accessory compatibility: Electronic cases are intended for the device models identified in the listing. Devices and other items shown for illustration are not included unless expressly stated.

Product safety: Small charms and accessories may present choking hazards. Follow the age restrictions and warnings on the product page and packaging. Shoe tattoos are intended for suitable footwear or accessories, not for skin or cosmetic use.

Product availability and descriptions may change. Changes do not remove your rights relating to an existing order.

SECTION 3 — ORDERS

Please review your selected product, size, color, quantity, delivery address, and order total before completing checkout.

An order acknowledgment confirms that we have received your order. Order acceptance is confirmed when we send a shipping confirmation or expressly confirm acceptance.

We may decline or cancel an order for legitimate reasons, including unavailable stock, payment failure, suspected fraud, delivery restrictions, or a material pricing error.

If we cannot fulfill your order, we will notify you and refund any payment collected for the canceled items. We will not substitute a different product or charge an additional amount without your agreement.

To request cancellation or an order change, contact wadelane486@outlook.com as soon as possible. Requests made within 12 hours of purchase can be considered, but cancellation cannot be guaranteed once fulfillment has begun.

Returns and exchanges are handled under our Refund and Return Policy, subject to applicable consumer law.

SECTION 4 — PRICES AND BILLING

The applicable currency and product price are displayed on the website and at checkout.

Shipping charges, applicable taxes collected by us, and other charges payable to us will be displayed before you submit your order. We will not add optional paid services without your consent.

For international orders, destination-country import duties, taxes, or carrier clearance charges may apply as explained in our Shipping Policy. Unless expressly included at checkout, these charges are not included in our prices.

Prices and promotions may change for future purchases. Except when correcting an error as described in Section 12, changes will not affect the agreed price of an existing order.

Promotions may have separate eligibility requirements and expiration dates, which will be disclosed with the offer.

You agree to provide accurate billing information and use an authorized payment method.

SECTION 5 — SHIPPING AND DELIVERY

Our Shipping Policy explains shipping destinations, processing times, delivery estimates, tracking, and shipment assistance.

Our current shipping options are:

Order processing normally takes an additional 1–3 business days, excluding weekends and holidays.

Shipping availability depends on the destination and the options offered at checkout. Delivery estimates are not guaranteed dates.

We will provide tracking information when available. Tracking updates may take time to appear after dispatch.

If your shipment is delayed, damaged, or missing, contact us for assistance. We will investigate with the carrier and arrange an appropriate remedy for confirmed loss or damage during transit. Handing a package to a carrier does not, by itself, remove our obligations to you.

If we cannot ship within the promised timeframe, we will notify you and provide delay information and cancellation or refund options as required by applicable law.

SECTION 6 — INTELLECTUAL PROPERTY

Website content, including text, layout, graphics, and other materials, is owned by us or the relevant rights holders and is protected by applicable intellectual property laws.

Crocs, Jibbitz, Shopify, and other brand names, logos, and trademarks belong to their respective owners. Product references identify the listed products and do not, by themselves, indicate sponsorship, endorsement, or an authorized retail relationship.

You may use our website for personal shopping and other lawful purposes. You may not reproduce or commercially exploit protected content without permission from the relevant rights holder, except where permitted by law.

SECTION 7 — OPTIONAL TOOLS

Some features, such as tracking tools or other optional services, may be provided by third parties.

Third-party tools may have their own terms and privacy policies. Please review those terms before using an optional service.

We do not control third-party websites or guarantee their uninterrupted availability. However, using third-party providers does not remove our responsibilities for orders placed with Txrmetal.

Our website may contain links to third-party websites for product information, tracking, payment services, or other resources.

A link does not necessarily constitute an endorsement. Third-party websites operate under their own terms and privacy policies.

For assistance with an order placed through Txrmetal, please contact us directly, including when a third-party carrier or service provider is involved.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Txrmetal is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Txrmetal. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Txrmetal, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Txrmetal.

This section applies only to the extent permitted by applicable law and does not waive rights or liabilities that cannot legally be excluded.

SECTION 10 — PRIVACY POLICY

Our collection and use of personal information are described in our Privacy Policy.

Shopify also processes information to operate and support the store. You can review Shopify’s Privacy Policy.

Information may be shared with service providers, such as payment processors, fulfillment providers, and carriers, as described in the applicable privacy policies. Some providers may process information in countries other than your country of residence.

SECTION 11 — FEEDBACK AND REVIEWS

You may submit honest reviews, suggestions, and other feedback about your shopping experience.

You retain ownership of your feedback. When you submit content for publication, you grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and format that content for operating and promoting our Services, subject to applicable law and our Privacy Policy.

We will not alter a review in a way that misrepresents its meaning. We will not require positive feedback as a condition of providing a refund or other remedy.

We may remove spam, fraudulent reviews, unlawful content, or content that violates others’ rights. Negative feedback alone is not a reason for removal.

We aim to keep product descriptions, prices, availability, and shipping information accurate.

If we discover a material error affecting your order, we will contact you with the corrected information. Where appropriate, you may choose to proceed on the corrected terms or cancel for a refund.

We will not increase the amount charged or materially change your order without your agreement.

If we cancel an order because of an error, we will notify you and refund the amount collected for the canceled items.

We may restrict access when reasonably necessary to prevent abuse or protect the Services. Restrictions do not cancel your rights relating to paid orders, refunds, or lawful complaints.

Automated tools used to access the Services must operate lawfully and respect applicable technical access controls and reasonable usage limits.

You may not use automated tools to commit fraud, bypass security controls, collect personal information unlawfully, or disrupt website performance.

Customers may use lawful assistive technology and shopping assistance tools. You remain responsible for reviewing and authorizing orders placed on your behalf.

You may stop using the Services at any time.

We may suspend or terminate access for a material breach of these Terms, suspected fraud, unlawful conduct, or security reasons.

Termination does not remove our obligations relating to existing orders, refunds, personal information, or rights that continue under applicable law.

Provisions intended to continue after termination, including intellectual property and lawful dispute provisions, will remain effective.

SECTION 16 — DISCLAIMER OF WARRANTIES

We take reasonable care to provide accurate information and maintain a functioning shopping service. However, we cannot guarantee that website access will always be uninterrupted or free from technical errors.

To the extent permitted by law, website functionality and optional informational tools are provided on an “as available” basis.

This disclaimer does not exclude any express product promise, applicable product warranty, right to receive goods as described, or other consumer protection that cannot legally be excluded.

A manufacturer’s warranty, where available, is subject to its own eligibility requirements. We do not promise manufacturer warranty coverage unless it is expressly stated for the product.

To the extent permitted by applicable law, we are not responsible for indirect or consequential losses that were not reasonably foreseeable when the purchase agreement was made.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, personal injury where liability cannot legally be limited, or other liability that cannot be excluded by law.

This section does not limit our obligations to provide applicable refunds, replacements, or other legally required remedies.

SECTION 18 — INDEMNIFICATION

To the extent permitted by law, you are responsible for third-party claims directly resulting from your unlawful use of the Services, infringement of another person’s rights, or material breach of these Terms.

This obligation does not apply to claims caused by our negligence, misconduct, or breach of our obligations.

We will notify you of a relevant claim and provide a reasonable opportunity to participate in its resolution. We will not agree to a settlement that imposes obligations on you without your consent.

SECTION 19 — SEVERABILITY

If a provision of these Terms is found unlawful or unenforceable, it will be limited or removed only to the extent necessary.

The remaining provisions will continue to apply, subject to applicable law.

SECTION 20 — WAIVER; ENTIRE AGREEMENT

A failure to enforce a provision on one occasion does not waive the right to enforce it later.

These Terms, together with the policies and order information incorporated into them, form the agreement governing your use of the Services and purchases from us.

They do not exclude any product promise, representation, or consumer right that applicable law requires us to honor.

SECTION 21 — ASSIGNMENT

You may not transfer your obligations under these Terms without our agreement, except where permitted by law.

We may transfer our rights and obligations as part of a lawful business transfer, provided this does not reduce your existing consumer rights or our obligations relating to your order.

These Terms are governed by the laws of the State of Florida and applicable United States federal law, subject to mandatory consumer protections that apply in your place of residence.

Nothing in these Terms prevents you from bringing a claim in a court or using a dispute-resolution process available to you under mandatory applicable law.

Headings are included for convenience and do not change the meaning or scope of these Terms.

SECTION 24 — CHANGES TO TERMS OF SERVICE

We may update these Terms to reflect changes in our Services, business practices, or legal requirements.

Updated Terms will be published on this page. We will provide additional notice of material changes where required by law.

Changes will apply prospectively and will not retroactively reduce rights relating to orders already placed.
